To connect through a 56Kbps modem at anywhere around 38,000bps to 44,000 is completely normal.

Connections are very much dependant on line quality and signal strength. Resistance or 'noise' on the line or a poor quality line can reduce connection speeds significantly.

If you believe that your connection speed is excessively low however, after checking that your driver is updated to its latest version, your line provider may be able to offer a corresponding check on the line.

Also normal is downloading at 4-5KBps, this is due to the difference between a bit (b) and byte (B) This case sensitivity applies to networking and storage in general.
